Another day, another amazing podcast to do your cardio to. Reading Is Fundamental, a podcast that combines sex, drag, politics, and law, is back and now presented by Fleshbot! In their first episode of Season 2, our favorite attorneys Dextra DeNovo and Blue Bailey break down the Drag Ban in Tennessee, covering what it means, who it affects, and the penalties for not complying. We also chat about Lizzo’s newest trademark and her journey to get “100% That Bitch” registered. Court is in session!

In the season 2 premiere, Blue breaks down the definition of “harmful performance” for Dextra and their listeners. According to Blue, the term is referring to an adult cabaret performance, which the good ol’ United States defines as both sexually explicit and void of artistic merit (who writes this $h*t?) Personally, I fail to see what is sexually explicit about a performer whose genitals are concealed under countless layers of duct tape and chiffon (can they even find it at that point), and one eyelid on a drag queen alone has more artistic merit than the entirety of the MoMA, just sayin’...

Our hosts’ conversation shifts to constitutionality as well as potential legal challenges. Dextra explains that the conveniently broad and vague definitions may be challenged under the First Amendment protections and the potential of bringing free speech claims under it. Dextra also expresses her concern about the conservative leanings of the Supreme Court and worries that such a painfully conservative court may even create a new category of obscenity specific to children. Jesus Christ, these two really are lawyers.

Our glam queen and leather daddy also dish on Lizzo’s trademark application of the oh-so-popular phrase “100% that b*tch.” Who even knew that b*tch Lizzo even tried to trademark that $h*t? I’m feeling some Paris Hilton “that’s hot” vibes here. Well, apparently she tried it, and the attorney argued that the phrase was “too common” (kinda like her last single) and could not be associated exclusively with Lizzo. Sorry babe, can’t win ‘em all. I’m sure she’s drying her tears with 100’s.
