It's Still Illegal To Engage in Gay Sex In Texas!

You've just arrived at your destination of Dallas, Texas, and you've just put your luggage down in your hotel room and logged on to the hookup apps to find a wide variety of hot gay men, from cowboys to pretty men, and are ready to do the deed. Not so fast! Engaging in gay sex is still illegal in Texas. It is considered "deviant sex" and is a Class C misdemeanor and you may be fined $500 for having anal. Say what? How is it that in 2024, gay sex is still on the law books?

In 2003, the Supreme Court ruled in the case Lawrence v. Texas that laws against sodomy were unconstitutional and, in theory, unenforceable. Anti-sodomy laws were first introduced into the books in 1973. Democratic lawmakers have been trying to fight the law for years, since 2005 to be exact. Introduced bills just haven't made it off the floor in time for legislative sessions. It came very close last year.

Lawmakers are trying yet again to repeal criminal prosecution for gay sex. The state's legislation's first session is January 14th and Democrats have two bills ready to go - one for the House and one for the Senate. They are also trying to get gay sex as an "unacceptable lifestyle" removed from the state's sex education guidelines. This coming year will be an uphill battle for the proposed bills. We know what happened with the Presidency election and Republicans are in control of the upcoming administration. Just like abortion protection has been changed, many fear laws in place to protect the queer community will be in jeopardy. Gay sex being punished by law? Get the jails ready, we do like our sex!

In other anti-LGBTQ things happening in Texas, the city council of Odessa passed a law last month that clearly targets the trans community. In that city, if you "catch" a trans person using a bathroom that does not correlate to the sex of their birth, you can sue them for a minimum of $10,000. WTF? They've also expanded the ban to include locker room and changing room use. In addition to personally suing a trans person, they can also be fined $500 by the city. There have been no reported events to Odessa police that have involved a trans person in bathrooms. So where does this law get its foundation? Duh. Just clear transphobia.
