But as millions of eyes begin to focus on the hitherto hidden charms of highway rest stops and public toilets, are otherwise law-abiding pervs like us still going to be able to break the monotony of our evening commutes with a innocuous quickie blowjob at the video arcade without a newly vigilant law enforcement apparatus breathing down our necks and/or responding to our own furtive tapping on the other side of that divider?     Since the Supreme Ct. held that sex between consenting adults cannot be a crime, the police have been looking for ways to continue arresting gays. It was generally a crime, punishable in many cities and states by mandatory jail time to ask another man if he wanted his cock sucked. Since the Supreme Ct. ruling this is just another form of free speech. Speech does not have to be spoken. Tapping your foot under the stall is a form of speech. Note that the Senator was arrested for “Invasion of Privacy.” Despite that the police have gone out of their way to talk about the sexual aspects which have nothing to do with the crime. The constitutionality of this law would need to be litigated. However if the officer tapped back which he must have to get the Senator to change stalls, there would be no expectation that the person in the next stall wanted privacy and thus no crime. This is different than entrapment altho that may apply as well.

    You need to read the entire police report. Count one was for Invasion of Privacy which was cited when Craig’s peeped at the Officer through the crack in the door, not for foot tapping or any hand gestures.

    Count two was for Disorderly Conduct, which was based on the Senator’s actions once he entered the adjacent stall, and is completely justified under Minnesota state statute.
